Return and Refund Policy

These terms and conditions (hereinafter, the “Return Policy” or the “Policy”) govern the aspects related to the return and refunds of products purchased by each customer (the “Customer”) from OTB Fashion México, S. de R.L. de C.V. (“Diesel”) through the website diesel.com/en-mx (the “Site”). 

By purchasing Diesel products, the Customer accepts, without limitation or reservation, this Return Policy, which shall apply only to purchases made through the Site, without prejudice to the rights that may correspond to the Customer under the applicable legislation of the United Mexican States (“Mexico”), including, without limitation, the Federal Consumer Protection Law.

1. TERM FOR RETURNS 

Subject to the provisions of this Return Policy, the Customer may return products within a period of 30 (thirty) calendar days from the date on which: 

a) the products were received at their domicile; or 

b) the products were collected at a Diesel monobrand store located within Mexican territory and listed as an authorized Boutique on the Site. 

In both cases, the computation of the period shall stop on the date on which the Customer physically delivers the products to the courier company designated by Diesel, provided that such delivery is made within the period indicated above. 

2. CONDITIONS FOR PRODUCT RETURNS 

Diesel's goal is to ensure complete customer satisfaction with regard to Diesel products purchased on the Site. If the Customer is not satisfied with the products purchased on the Site, they may request a return and obtain a refund.  

Such return and corresponding refund shall be subject to the following conditions: 

(i) the products have not been used, washed, worn, damaged, or altered by the Customer; 

(ii) the products retain all original labels, packaging, and accessories in good condition; and 

(iii) the return and refund request is made within the time frame and under the conditions set forth in chapter 1 above.

3. PRODUCTS NOT SUBJECT TO RETURN 

Without prejudice to any rights that may correspond to the Customer under applicable Mexican law, returns will not be accepted, and refunds will not be granted for:  

(i) products that show wear, use, washing, damage, or alteration of any kind;  

(ii) products that do not have the original labels and/or packaging and/or accessories in good condition;  

(iii) products marked as “Final Sale” or with similar legends indicating that they are non-refundable, regardless of whether they meet the other conditions of this Return Policy;  

(iv) products that, by their nature, are not returnable, including, but not limited to, underwear, swimwear, gift cards; and 

(v) products purchased on sale or at a discount. 

Diesel reserves the right to refuse any return request when, in its reasonable opinion, the conditions set out in this Returns Policy are not met.

4. PROCEDURE AND COURIER SERVICE 

The Customer shall deliver the products they wish to return to a courier service following the procedure below: 

1. The Customer must complete the online return form to receive the prepaid return label from the courier service authorized by Diesel via email.  

2. This label will allow Diesel to cover, on behalf of the Customer, the shipping and tracking costs associated with the return. The Customer may arrange for collection directly with the courier service or deliver the package to an authorized drop-off point.  

3. If the Customer uses a service other than that authorized by Diesel, they will bear the cost of shipping and the risk of loss or damage during transport. 

The returns and refunds provided for in this Return and Refund Policy apply exclusively to purchases made through the Site.

5. REFUND 

Once Diesel receives the returned products, it will send an email to the Customer confirming whether it accepts the return and, if so, the applicable terms and conditions. 

If the return is accepted, the refund will be processed using the same payment method used for the purchase, once the products have been received, inspected, and approved by Diesel, within a maximum period of 15 (fifteen) business days from the date of acceptance of the return by Diesel. Any shipping costs incurred when making the purchase will not be refundable, unless the return is due to a product defect or error attributable to Diesel. 

If the returned products do not comply with the conditions set forth in this Policy, Diesel may retain them without any obligation to return them to the Customer or to refund the amount paid for them. 

6. IDENTIFICATION LABEL 

All products sold by Diesel have an identification label, which is an integral part of the product. Products must be tested without removing this label. Any product returned without the label will be rejected and retained by Diesel, without any obligation to accept the return or grant a refund.
